Hardware Limited Warranty
Tavve Software Company (“Tavve”) warrants for a period of one year from the date of initial purchase by the purchaser from Tavve (the “Warranty Period”) that the hardware accompanying the software licensed by Tavve in the sale of a ZoneRanger (the “Hardware”) shall be free of material defects in materials or workmanship. The purchaser may purchase an extended hardware warranty in one year increments on the anniversary of the original purchase date for $1,000 per unit (the “Extended Warranty Period”). Tavve’s sole obligation, and customer’s exclusive remedy for any material defect in the Hardware shall be, at Tavve’s option, to repair or replace the defective Hardware.
Tavve shall bear no responsibility for correcting, curing, or otherwise remedying any defect in the Hardware if (1) the Hardware is not properly installed; (2) the Hardware is not maintained and operated under normal conditions by qualified personnel; (3) the Hardware incorporates spare or replacement parts other than those installed by Tavve; (4) the Hardware has been altered, abused, misused, or taken apart or (5) the purchaser fails to provide Tavve with notice of the material defect during the Warranty Period or Extended Warranty Period if extended warranty is purchased.
DISCLAIMER: With the sole exception of the preceding undertakings, TAVVE DISCLAIMS ANY AND ALL PROMISES, REPRESENTATIONS, AND WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE HARDWARE INCLUDING ITS CONDITION, THE EXISTENCE OF ANY LATENT OR PATENT DEFECTS, AND ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR USE.
OBTAINING WARRANTY SERVICE: To obtain service under this limited warranty, you must contact TAVVE Technical Support. You may contact TAVVE Technical Support via email, support@tavve.com, support ticket in TAVVE ticket portal, support.tavve.com, or telephone, 919-654-1235. TAVVE Technical Support personnel will work to resolve issues professionally and quickly. However, you must reasonably assist TAVVE in providing technical support services. Procedures for handling parts and replacements are outlined below. Warranty service may be denied or limited if your account is not in good standing, including outstanding debt for replacement parts not returned to TAVVE. If you choose to contact TAVVE in writing, send your request for warranty service to the following address: Tavve Attn: Support, 201 S. College Street, Suite 1590, Charlotte, NC 28244. Whether you are obtaining replacement parts, having repairs, or returning the entire product and accessories for a replacement, the following procedures must be followed. FAILURE TO FOLLOW THE PROCEDURES SET OUT IN THIS SECTION MAY RESULT IN DELAYS IN THE REPLACEMENT OF PARTS, REPAIR, OR REPLACEMENT OF YOUR PRODUCT, OR MAY RESULT IN ADDITIONAL CHARGES TO YOUR ACCOUNT. TAVVE RESERVES THE RIGHT TO REFUSE TO ACCEPT PRODUCTS WHERE THESE PROCEDURES ARE NOT FOLLOWED.
A. If the technician decides that TAVVE will replace part(s) or product, he or she will authorize an advance replacement of the product. YOU MUST RETURN THE DEFECTIVE PART(S) OR PRODUCT UNLESS YOU ARE AUTHORIZED IN WRITING BY TAVVE TO RETAIN OR DISPOSE OF THE PART(S) OR PRODUCT. IF YOU FAIL TO RETURN THE DEFECTIVE PART(S) OR PRODUCT WITHIN SEVEN (7) DAYS OF RECEIPT OF THE RMA KIT, YOU WILL BE RESPONSIBLE FOR THE ORIGINAL SALES VALUE OF THE REPLACEMENT PART(S) OR PRODUCT.
C. Back up and download all product profiles before returning the product and/or accessories for repair or replacement. TAVVE IS NOT RESPONSIBLE FOR ANY LOSS OF YOUR DATA.
D. Return any product or accessories in the original packing materials, or if these are not available, other suitable packing materials to prevent further damage. Write the support ticket number in large, clear characters on the outside of each box you ship. FAILURE TO INCLUDE THE SUPPORT TICKET NUMBER MAY RESULT IN DELAYS.
E. FOR YOUR PROTECTION, INSURE THE SHIPMENT FOR FULL REPLACEMENT VALUE. YOU ARE RESPONSIBLE FOR ANY DAMAGE TO THE PRODUCT OR ACCESSORIES THAT OCCURS DURING SHIPMENT TO TAVVE.
INTERNATIONAL CLIENTS. The limited warranty is the same for clients who are located outside of the United States, except as stated in this paragraph. TAVVE IS NOT RESPONSIBLE FOR ANY CUSTOMS FEES, TAXES, OR VAT THAT MAY BE DUE. YOU ARE RESPONSIBLE FOR THESE CHARGES, EVEN IF YOU REFUSE DELIVERY OF THE PRODUCT. ON ALL ORDERS FOR SERVICE, YOU ARE RESPONSIBLE FOR SHIPPING, HANDLING, AND INSURANCE CHARGES TO AND FROM TAVVE, CUSTOMS FEES, TAXES, OR VAT THAT MAY BE DUE.
